AT WORK

Daniel J. Struck is an experienced litigator who represents corporate and individual policyholders throughout the United States in insurance coverage litigation and provides counsel regarding complex insurance advisory matters.

Dan advises clients with respect to the structure, negotiation and placement of their insurance programs, including directors and officers, fiduciary liability, employment practices liability, media liability, crime, representations and warranties, Internet activity, bankers liability, general liability, environmental liability, product recall, builders risk and first party property insurance. He counsels clients on the structure and negotiation of wrap, difference-in-conditions and captive insurance products, and provides guidance on insurance-related due diligence and the insurance implications of corporate spin-offs and changes in corporate control. Dan also advises clients concerning the availability of coverage under current and legacy insurance programs for potential and actual claims.

Dan has represented clients from a broad range of industries, including financial services, media and publishing, mortgage banking, electric and other utilities, retail, food and consumer goods, biotechnology and manufacturing. He regularly conducts insurance coverage audits, helping businesses identify potential risks and gaps in coverage, and implementing enhancement initiatives.

IN THE PROFESSION

While in law school, Dan received a fellowship to practice in the public sector and garnered the Kapelsohn Prize for excellence in legal writing in labor law. After earning his law degree, he was an assistant corporation counsel in the New York City Law Department, where he focused on commercial, governmental procurement and civil rights litigation. Dan subsequently served as a law clerk to the Honorable Brian B. Duff of the U.S. District Court for the Northern District of Illinois before entering private practice.

A frequent speaker and writer on insurance-related matters of interest to corporate policyholders, Dan has served as the update editor of a leading insurance law treatise and has authored client updates on a number of insurance counseling topics such as settlement and recovery strategies and broker conflicts of interest. He also has delivered in-house training programs on directors and officers insurance and has served as a panelist concerning insurance issues to trade group seminars.

Dan is a member of the American Bar Association's Section on Insurance Law.
