AT WORK
Robert J. Emanuel is an experienced litigator and trial attorney who concentrates his practice on the defense of banks, mortgage lenders and servicers, and related industry clients in consumer financial services litigation. He represents companies in matters involving disputes under the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA). Robert also defends clients against claims brought under various state consumer protection statutes, qui tam and whistleblower lawsuits, and alleged RICO violations. Recent cases he has handled have included individual, multidistrict and class action lawsuits alleging credit defamation, consumer fraud, payment processing errors, and disputes involving business and consumer services.
Robert understands the value of dispute prevention as a precursor to dispute resolution, and regularly counsels banking and other clients on managing exposure to class action and individual litigation, in addition to helping ensure compliance with state and federal regulations. When litigation is the best option for achieving client goals, Robert draws on his experience in every aspect of managing a case, from fact investigations and strategy development, to briefing and arguing class certification and other motions, conducting and defending depositions, and negotiating settlements.
IN THE PROFESSION
Robert is a member of the Executive Committee of the Board of Directors of the Illinois Mortgage Bankers Association (IMBA), where he serves as Vice Chair of the Legislative Committee and as Co-Chair of the Legal Issues and Regulatory Compliance Committee.
