Probate Litigation

Probate is the court process for settling a decedent's estate, ensuring that assets are properly identified and administered, debts, taxes and expenses are paid, and that the remaining assets are distributed to the lawful beneficiaries. In addition to the services provided by our Wealth Transfer & Succession Planning attorneys, prior to a client's death, we represent personal representatives, trustees and beneficiaries throughout the probate process, including opening and closing estates, collecting assets, filing and defending against claims, and counseling on transfer tax matters, income tax planning, disclaimers and resolution of conflicts among beneficiaries.

Our attorneys have a long history of helping clients through the probate process and settling disputes when they arise. For example, in recognition of his service to clients and the community, one of our attorneys was appointed by the Governor of Illinois as the Public Administrator of Cook County. During his tenure, he was responsible for managing probate estates for more than 2,000 individuals who died intestate, with no named administrators or known heirs.
