General

These terms of use (“TOU”) apply to the website located at www.muchshelist.com (the “Site”) owned and operated by Much Shelist, P.C. (“we”, “our”, “us”) however accessed and/or used, whether via personal computers, mobile devices or otherwise.  These TOU include acceptance by visitors to the Site (“visitors”, “you”, “your”) of the Privacy Policy.

The materials posted and available on the Site have been prepared by Much Shelist for informational purposes only and should not be used or construed as legal advice on any subject matter nor as advertising. Visitors to the Site should not act upon this information without first obtaining legal or professional counsel based on the visitors’ specific facts and circumstances from an attorney licensed in the visitor’s state.

Neither receipt of this information nor sending an e-mail to any attorney or others at Much Shelist creates an attorney-client relationship. If you are not currently a client of Much Shelist, your e-mail or other communications may not be privileged and could possibly be disclosed to other persons.

By entering the Site you acknowledge and agree that anything you transmit to the Site or to Much Shelist through the Site will not be treated as confidential or proprietary, and all such material can be used by Much Shelist anywhere, anytime and for any reason. Information and communications will be treated as confidential only after Much Shelist has been retained as legal counsel and this relationship has been confirmed in writing.

The Site is intended for a general audience ages eighteen (18) years or older.  If you are under eighteen (18) years of age, you are prohibited from using the Site.

Reproduction of Materials, Copyright and Trademark

Much Shelist is the copyright and trademark owner of everything on the Site including content, names, logos, trademarks and service marks and their design, selection and arrangement. No portion of the Site, including but not limited to the text, audio, video or software, may be used or modified in any manner or for any purpose without the express, prior written permission of Much Shelist. You may make one copy of the content for non-commercial, personal use. All copies of any content must be authorized and display the original copyright notice, trademark legend, author attribution or other notice(s) placed on such content. Any reproduction, distribution, republication and/or re-transmission of materials from the Site is strictly prohibited except as expressly allowed hereunder or in writing by Much Shelist.

Downloading and Use of Materials

You assume full responsibility and risk for any damage resulting from your downloading or use of any information, software or other materials through the Site.

Internet Risks

You acknowledge and agree that electronic communications and databases are subject to errors, omissions, tampering and break-ins that, notwithstanding Much Shelist's implementation of reasonable security precautions, may occur. Much Shelist does not guarantee or warrant that any such events will not take place. You agree to follow all access and security procedures provided by Much Shelist and not attempt, nor aid or abet any other person, to circumvent or interfere with these security procedures.

The Site and its contents are provided “AS IS” without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.  Much Shelist makes all reasonable efforts to ensure that the material on the Site is correct and up-to-date. Much Shelist, however, cannot guarantee, and makes no warranties or representations regarding, its accuracy or timeliness.
Links/Third-parties

Although the Site may be linked to third-party and/or other sites, Much Shelist is not, directly or indirectly, implying any approval, sponsorship, association, endorsement or affiliation with the linked site unless specifically stated otherwise by Much Shelist in writing. Much Shelist is not responsible for the content of pages owned or operated by any individual or organization other than Much Shelist.

Jurisdiction

The Site was created and is operated under the laws of the State of Illinois, which will govern these disclaimers and policies, without giving any effect to any principles of conflict of laws. We retain the ability to enforce our rights in any court of competent jurisdiction; however, you consent to the exclusive jurisdiction and venue of courts in Chicago, Illinois regarding any and all disputes relating to these Terms of Use, policies of or any part of the Site.

Circular 230 Disclosure

Pursuant to regulations governing practice before the Internal Revenue Service, any tax information or opinions contained herein are not intended or written to be used and cannot be used by a taxpayer for the purpose of avoiding tax penalties that may be imposed on the taxpayer.

Agreement

By entering the Site, you acknowledge and agree to all terms and conditions stated in these TOU and all other policies posted on the Site. If you do not agree to these TOU and all other posted policies, including, without limitation, the Privacy Policy, you are prohibited from using the Site.

Changes to these TOU

We reserve the right to change these TOU as we deem reasonable and appropriate.  Any changes to the TOU will apply as soon as they are posted and you visit the Site. The "last revised" date at the beginning of these TOU reflects the date of the most recent changes to them. We encourage you to check the "last revised" date whenever you visit the Site (or as often as you feel appropriate) to see whether or not changes have been made to these TOU. We may also from time to time in our sole discretion post notices on the Site if there have been what we deem to be material changes to these TOU.
